1. Introduction

Welcome to www.azitzartstudio.com ("we", "us", "our"). These Terms of Use govern your use of our website and the purchase of artwork from our online store.

By accessing our website or placing an order, you agree to be bound by these Terms of Use.  If you do not agree with these terms, please do not use our website.

3. Our Artwork

We create and sell original handmade artwork and limited-edition art prints.  Where stated:

  • Prints are produced in limited editions.

  • Limited-edition prints are signed by the artist.

  • Edition sizes are specified on the product listing.

  • Each artwork may be individually framed or mounted dependent on buying choice.

  • Frames are glazed using museum-quality or art-grade acrylic glazing rather than glass.

As all artwork is handmade, slight variations in colour, texture, framing, or finish may occur. Such variations are part of the nature of handmade artwork and do not constitute defects.  We make every effort to display colours accurately, but colours may vary depending on your device or monitor settings.

4. Ordering

When you place an order through our website, you are making an offer to purchase artwork.  An order is only accepted when:

  • payment has been successfully received; and

  • we send you an order confirmation email.

We reserve the right to decline any order for any reason, including but not limited to pricing errors, stock availability, or suspected fraudulent activity.

5. Pricing and Payment

All prices are displayed in Pounds Sterling (£).  Prices include VAT where applicable.  Payment must be made in full at the time of ordering using the payment methods available on the website.  We reserve the right to change prices at any time, but price changes will not affect orders already accepted.

 

6. Shipping and Delivery

We currently deliver to locations specified on our website.  Delivery times are estimates only and are not guaranteed.   Artwork will be carefully packaged to minimise the risk of damage during transit.

 

Risk in the artwork passes to you when the artwork is delivered to the delivery address provided.  Ownership of the artwork remains with us until full payment has been received.

7. Damaged Deliveries

Please inspect your artwork upon delivery.  If your artwork arrives damaged, you must notify us within 48 hours of receipt and provide:

  • photographs of the damage;

  • photographs of the packaging; and

  • your order number.

We may require the damaged artwork and packaging to be retained while a claim is investigated.  Subject to verification, we will repair, replace, or refund the artwork as appropriate.

8. Consumer Cancellation Rights

If you are purchasing as a consumer within the United Kingdom, you may have statutory rights under the Consumer Contracts Regulations 2013.

Subject to any applicable legal exceptions, you have the right to cancel your order within 14 days of receiving the artwork.

To exercise your right to cancel, you must notify us in writing by email.  You must return the artwork to us within 14 days of cancellation.

Unless the artwork is faulty or incorrectly supplied, you are responsible for return shipping costs.  Refunds will be issued within 14 days of receiving the returned artwork or evidence that it has been returned.

9. Exceptions to Cancellation Rights

The right to cancel may not apply to:

  • commissioned artworks;

  • personalised artworks;

  • bespoke framing or customised products;

  • any item made to your specific requirements.

Where an exception applies, this will be stated before purchase.

10. Intellectual Property

All content on this website, including artwork, images, photographs, designs, logos, text, and graphics, is owned by or licensed to us and is protected by intellectual property laws.  Purchasing artwork does not transfer copyright.

 

Unless expressly agreed in writing, customers may not:

  • reproduce artwork;

  • create derivative works;

  • use artwork for commercial purposes;

  • distribute copies of artwork;

  • publish artwork online for commercial use.

Copyright remains with the artist at all times.

11. Limited Edition Prints

Where artwork is described as a limited edition:

  • the edition size stated on the website represents the maximum number of prints intended for release in that edition;

  • prints may be signed and numbered by the artist;

  • a certificate of authenticity may be supplied where stated.

We reserve the right to retain artist proofs and archive copies.

12. Website Use

You agree not to:

  • use the website unlawfully;

  • interfere with website security;

  • attempt unauthorised access to systems or data;

  • upload malicious software or harmful code.

We may suspend or terminate access to users who breach these Terms.

13. Limitation of Liability

Nothing in these Terms excludes liability that cannot legally be excluded under UK law.

To the fullest extent permitted by law, we shall not be liable for:

  • indirect or consequential losses;

  • loss of profits;

  • loss of business opportunities;

  • losses arising from delays outside our reasonable control.

Our total liability relating to any order shall not exceed the amount paid for that order.

Our collection and use of personal data is governed by our Privacy Policy.

By using our website, you acknowledge that personal information may be processed in accordance with that policy.

15. Force Majeure

We shall not be liable for failure or delay in performing our obligations where such failure results from circumstances beyond our reasonable control, including:

  • natural disasters;

  • strikes;

  • transport disruptions;

  • governmental actions;

  • internet outages;

  • pandemics.

16. Changes to These Terms

We may update these Terms from time to time.  The latest version will always be available on our website.  Continued use of the website after changes are published constitutes acceptance of the revised Terms.

17. Governing Law

These Terms are governed by the laws of England and Wales.  Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
